These Terms and Conditions (“Terms”) govern your use of the NomNotes app, website, and related services. By creating an account or using NomNotes, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use NomNotes. By using the service, you represent that you meet this requirement and that the information you provide is accurate.

2. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized access to or use of your account.

3. Service Description

NomNotes provides tools for saving, organizing, processing, creating, and optionally sharing recipes, cooking notes, images, videos, transcripts, and related content. Certain features may use AI or third-party processing tools to extract, format, summarize, or generate recipe-related content.

4. User Content

You retain ownership of the content you submit to NomNotes. However, by uploading or submitting content, you grant NomNotes a non-exclusive, worldwide, revocable license to host, store, reproduce, process, adapt, display, and distribute that content solely for the purpose of operating, improving, and providing the service.

If you choose to share recipes, profile information, or other content with other members, you understand that such content may become visible within the service according to the sharing settings you select.

5. Acceptable Use

You agree not to:

• Use the service for unlawful, harmful, fraudulent, or abusive purposes.
• Upload content that infringes the rights of others, including intellectual property rights or privacy rights.
• Attempt to interfere with, disrupt, or compromise the security or integrity of the service.
• Use automated means to scrape, copy, or exploit the service without authorization.
• Upload malicious code, spam, or content that is obscene, threatening, or otherwise improper.

6. AI Features and Content Disclaimer

NomNotes may use AI-powered features and third-party services to process images, videos, text, transcripts, and recipes. AI-generated or AI-processed results may contain errors, omissions, or inaccurate interpretations. You are responsible for reviewing and verifying any recipes, cooking steps, ingredient quantities, allergy-related information, food safety details, and other outputs before relying on them.

NomNotes does not guarantee that AI-generated or AI-processed content will be accurate, complete, safe, or suitable for your intended use.

7. Subscriptions, Billing, and Renewals

Some NomNotes features may require a paid subscription. Subscription pricing, available features, trial periods, and renewal terms may change over time.

For iOS users, subscriptions purchased through Apple are billed and managed by Apple and may automatically renew unless canceled in accordance with Apple’s billing settings and terms. For web or future platform subscriptions, separate billing terms may apply.

You are responsible for reviewing your purchase terms at the time of subscription.

8. Account Deletion and Termination

You may stop using NomNotes at any time. You may also delete your account, subject to the features and procedures made available in the app or website. We may suspend or terminate your access if you violate these Terms, create risk for the service or other users, or engage in conduct that we reasonably determine is harmful or unlawful.

9. Intellectual Property

Except for user content, NomNotes and its related branding, design, features, software, text, graphics, and other materials are owned by or licensed to NomNotes and are protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the service except as allowed by law or with our written permission.

10. Third-Party Services

NomNotes may rely on third-party providers for hosting, subscriptions, cloud processing, OCR, AI features, analytics, communications, and other functions. We are not responsible for the acts, omissions, or policies of third-party providers, platforms, or app stores.

11. Disclaimers

NomNotes is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

12. Limitation of Liability

To the fullest extent permitted by law, NomNotes and its owner, operators, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the service.

To the fullest extent permitted by law, the total liability of NomNotes for any claim arising out of or relating to the service will not exceed the amount you paid to NomNotes, if any, during the twelve months before the event giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless NomNotes and its owner, operators, affiliates, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of your content, your use of the service, or your violation of these Terms or applicable law.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. If we do, we will post the revised version and update the effective date above. Your continued use of NomNotes after the updated Terms become effective means you accept the revised Terms.
